While PCXmods.com tries in good faith to make sure that the information in our online shop is accurate, we are not responsible for typographical errors or technical inaccuracies. In addition, we reserve the right to make adjustments due to errors, changing market conditions, product discontinuation or typographical errors in advertisements.

Due to the volatile pricing in our business, PCXmods.com cannot and does not offer any form of price protection.

Acceptance of Orders:

PCXmods.com reserves the right to refuse or cancel an order at any time and for any reason.

In addition, an automated electronic order confirmation does not indicate acceptance of an order. PCXmods.com does not accept purchase orders without prior written consent. Orders may not be cancelled once the order fulfillment process has begun, special order components have been purchased, or any products have been shipped. At that time, all sales are final and are subject to the terms set forth in this document.

Product Warranty and Technical Support:

Warranties are non-transferable and apply to the original purchaser only.
Warranties begin from the date the product is shipped by PCXmods.com.

We are not responsible for incompatibility issues or for products not purchased from PCXmods.com. The warranty will be voided by neglect, abuse/misuse, overclocking and physical damage. Technical support may be requested by e-mailing contactATpcxmods.com.

Please do not contact our sales staff via email for support or RMA issues. Technical support is available for the duration of the warranty as detailed below.

Return for Refund or Credit:

If you are not satisfied with the product you purchased from PCXmods.com, you may return it to us and obtain a credit or refund excluding shipping, handling and labor charge. A restocking fee of 15% will be applied on all returns with no exceptions. Amount of refund will be calculated based on current selling price listed on our website or original invoiced amount, whichever is lower.
Any opened retail packaged components or software does not qualify for a refund or credit, nor do any barebones or full systems. Processors (CPUs) and memory modules cannot be returned for refund or credit, opened or unopened. To qualify, you must return the product and any accompanying cables, connectors, reference manual, media or other associated documentation in its original packaging so that it arrives to PCXmods.com within a period of 30 calendar days from invoice date, no exceptions.

Returning Products to PCXmods.com:

Before returning any product, please contact our Tech Support Department to obtain a Return Merchandise Authorization (RMA). An RMA is valid for 10 days after the date of issuance. The RMA number must be prominently displayed only on the shipping label of boxes containing returned goods. Do not mark the boxes themselves. Any product returned without an RMA number, incomplete and/or not in resalable condition, or with an RMA number over 10 days old, will be refused and returned at customer's expense.

All returned goods must be shipped freight prepaid at customer's expense in their original boxes and packing material. A copy of your invoice must accompany all returned products, along with a detailed description of problem(s) encountered. Returned goods should be freight insured by you. Product(s) returned to you under warranty will be shipped freight-prepaid via FedEx or UPS. pcxmods.com reserves the right to charge for shipping, handling and labor if the product received for repair, exchange or replacement is non-defective. PCXmods.com does not offer cross-ship replacement of any products we sell.

Payment Due:

Payment for the products listed on the enclosed packing list/invoice is due upon shipment. You agree to pay as we specify on the invoice. Software programs, including those that are pre-loaded on to PCXmods.com systems are licensed to you under the manufacturer's, supplier's, or publisher's terms and conditions provided with the respective packages included in the shipment.

Telephone Assistance:

If there is a problem with a product you purchased from PCXmods.com, you should refer to the user's reference manual for assistance. Except as is otherwise stated herein, if you are unable to resolve a problem with a product, you may contact us at no additional charge, via email at ckahlATpcxmods.com. The original component manufacturer, supplier or publisher of any products other than complete computer systems with the pcxmods.com brand logo is responsible for providing any service or support with these products.

Shipping Policy:

If you choose UPS as your shipper and do not input the correct address for the shipping destination, your package will be returned to us. In such a case, UPS charges a $10 US service fee which we pass on to you and will charge to your credit card. You are obligated to pay for shipping again, no matter what carrier you choose, if you still wish to receive your original order. If you should choose not to continue with the transaction, PCXmods will charge you a 15% restocking fee and the $10 service fee to your credit card.

Limited Warranty:

All PCXmods.com items are warranted to be free of defects in materials or workmanship for a period of 30 Days from date of shipment. All components purchased from PCXmods.com which are not sold as part of a PCXmods.com system, are warranted to be free of defects in materials and workmanship for a period of 30 days from date of shipment. Components may have additional warranties by their publisher or manufacturer in replacement or addition to this warranty. This warranty does not cover any abuse, misuse or modification of products. We reserve the right to repair or replace the defective product under warranty as we see appropriate. We do not warrant uninterrupted or error-free operation of a product. We do not warrant that any product that you acquire will meet your individual needs.

PCXmods.com DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES WITH RESPECT TO THE PRODUCTS, WHETHER EXPRESSED, IMPLIED OR STATUTORY, AND INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Title to Products:

Title is transferred to you when a product is shipped Freight On Board (FOB) shipping point.
However, we reserve a purchase money security interest in the product until we receive the amounts due. You agree to allow us to sign an appropriate document on your behalf to permit us to protect our purchase money security interest.

Limitation of Liability:

Under no circumstances are we liable for the following: (1) third-party claims against you for damages; (2) loss of, or damage to, your records or data; or (3) economic consequential damages (including lost profits or savings) or incidental damages even if we are informed of their possibility. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.

General:

All of your rights, all of our obligations and all licenses (except as specifically granted), are valid only in the United States, Puerto Rico, and Canada. Neither of us will bring legal action more than one year after the cause of the action arose. The laws of the State of Utah shall govern this Agreement.
